C.A.S.H. - the Committee to Abolish Sport Hunting has first-hand knowledge of the miscarriage of justice involving the "Hunter Harassment Statutes" in several states.
Jan Haagensen's case is especially outrageous. Jan is a landowner and an attorney in Pennsylvania. After Jan told a hunting party that was approaching her and her land not to trespass, Jan was charged with no less than six counts of hunter harassment.
Rather than accept a plea-bargain which would have resulted in a nominal fee and allowed her to continue her law practice, Jan chose to fight the charges in court so that she could prevent this from happening to others. She lost her case in the local court where "judges" typically are appointed by the "good ol' boys" or pushed through by the "good-ol' boys" machine. Often, such "judges" are politically connected residents with no legal training so it is no surprise that the judge found Jan guilty on all six counts.
After moving her case to an appellate court with real judges, Jan won! The Commonwealth of Pennsylvania didn't attempt to justify the trial court's outrageous decision, and didn't bother to file a response to her appeal.
Jan's victory in appellate court has since been entered as case law in "Purdon's Pennsylvania Statutes arid Consolidated Statutes Annotated." Purdon's is the Commonwealth of Pennsylvania authority for case law citations. 34.PA.C.SA. §2302 and 29a Pa D 2d-63 Key No.9 refer to Jan's case and her decisive victory over the bogus trial court decision.
This decision has positive to consequences for us! Now any future and similar hunter harassment case will be more easily dismissed because of the case-law established by Jan Haagensen's decisive and courageous action.
C.A.S.H. is currently in the process of seeking funding to bring Jan Haagensen's civil case against local law enforcement forward. If she succeeds - and given her victory in appellate court it seems likely that she will - then local law-enforcement will be hesitant to recklessly charge people with hunter harassment.
All of this is being done with an eye towards overturning hunter harassment statutes that have kept those who oppose hunting, especially on their own land, in a stranglehold.
WE URGE YOU TO HELP OVERTURN THE HUNTER HARASSMENT STATUTE IN PENNSYLVANIA AS A MAJOR STEP TOWARD OVERTURNING IT NATIONALLY. PLEASE SUPPORT C.A.S.H. WITH A GENEROUS TAX-DEDUCTIBLE DONATION TODAY!
Thank you for everything you do for animals!
