Citation: At approximately 1350 hrs I observed the following non-compliance. In the processing room I found packages of 5 lb. bulk ground Italian sausage that was processed and labeled on Saturday February 12, 2011, without inspection. All 6 of the Packages had the marks of inspection on the packages. U.S. Retain tag NO. B39878907 was applied to the product. After talking with plant employees, they informed me that it was done for the retail store. I proceeded to look in the freezer for more sausage that was completed on that date. I then came across a box of more Italian sausage in the freezer that was packaged on February 5, 2011 with the marks of inspection. Again these 7, 5 lb. bulk packages were produced on a Saturday without inspection. U.S. Retain tag NO. B39878908 was applied to the box with the 7 packages of 5 lb. bulk Italian sausage. I informed the plant employees that these packages cannot have the marks of inspection applied to them because they were produced outside of approved inspection hours and they did not have an inspector on duty nor did they have the authorization to process with inspection outside of inspection hours and that this was noncompliant with in Federal Regulations. After I informed the plant employees of the non-compliance they proceeded to remove the marks of inspection from all of the retail packages that were retained. After I re-inspected the packages to ensure that the marks of inspection were removed I removed both of the U.S. Retain tags and custody of the bulk Italian sausage was released back to the establishment. This document serves as notice of non-compliance with in Federal Regulation 9 CFR 307.4(a) and 316.3.

Regulation:

307.4(a) No operations requiring inspection shall be conducted except under the supervision of a Program employee. All slaughtering of animals and preparation of products shall be done with reasonable speed, considering the official establishment’s facilities.

316.3(a) No person shall affix or place, or cause to be affixed or placed, the official inspection legend or any other official mark, or any abbreviation or simulation of any official mark, to or on any product, or container thereof, except under the supervision of a Program employee, or as authorized by part 317 of this subchapter in connection with the manufacture of containers.
