Citation: On 1/3/2012 at approximately 0430 hours I observed the following non-compliance after returning to the establishment to collect a personal item that I had forgotten in the government office. I had originally left at 0400 hours when the establishment informed me that they no longer required inspection for the day because they would only be producing retail/custom products.[newline]I observed plant employee’s sealing packaged product that was marked inspected outside of inspection hours and without and inspection program employee present. When I asked a plant employee, he informed me that there were just the 2 trays of beef liver, beef tongue and beef hearts. I immediately took a regulatory control action and applied U.S. Retain Tag NO.B39879010 to one tray and U.S. Retain Tag NO.B39879011 to the other tray. I then informed of the non-compliance and informed him that I had applied a tag to both trays of product. On 1/4/2012 I talked to the employee who was sealing the product and he informed me that the beef hearts and beef tongues had already been packaged and labeled and that the beef liver had already been cut up but they were in fact packaged, labeled and sealed inspected without an inspector present or even notified.
307.4(a) No operations requiring inspection shall be conducted except under the supervision of a Program employee. All slaughtering of animals and preparation of products shall be done with reasonable speed, considering the official establishment’s facilities.
316.3 Use of official marks prohibited except under supervision of Program employee; removal of official marks, when required.
