Citation: At approximately 1115 hrs I found the following non-compliance. I found 33, 5 lb. boxes of ground beef hamburger patties that were produced on January 21, 2012 that were produced under the retail exemption but all of the packages had the marks of inspection applied to the label. As soon as I observed this non-compliance I informed the plant manager, , and took a regulatory control action and applied U.S. Retain Tag NO.B39879012 to the shelf that was holding the 33, 5 lb. boxes of ground beef hamburger patties that was marked inspected. Upon further investigation I found 7 more 5 lb. boxes of ground beef hamburger patties in the retail area. I informed the plant that they needed to take the product back to the shelf where the other improperly marked boxes were because they needed to be accounted for with concern to the marking of retail exempt products inspected. They were then placed in the same retained area in the establishment’s freezer with the other 33 boxes. According to the plant records they ground up a total of [#] pounds on Saturday January 21, 2012. [#] lbs were ground at 8:45 a.m. and [#] lbs were ground at 11:00 a.m. The cases add up to a total of [#] pounds. Through records of what the establishment produced on Saturday January 21, 2012 and with discussing the retail ground that was produced with the plant employee who produced the ground product under the retail exemption, I determined the plant more than likely only had the cases of 5 lb. ground beef patties that amounted to [#] lbs. I determined that the other [#] lbs was put in the retail display case and not packaged and or labeled inspected.

Regulation:

307.4(a) No operations requiring inspection shall be conducted except under the supervision of a Program employee. All slaughtering of animals and preparation of products shall be done with reasonable speed, considering the official establishment’s facilities.

316.3(a) No person shall affix or place, or cause to be affixed or placed, the official inspection legend or any other official mark, or any abbreviation or simulation of any official mark, to or on any product, or container thereof, except under the supervision of a Program employee, or as authorized by part 317 of this subchapter in connection with the manufacture of containers.
