Citation: At 1530 hours Dr. was escorting EIAO on a tour through the plant after she had conducted an FSA entrance meeting with establishment management. She had noticed in the retail cooler that there were some vacuum packaged products in a grey tote that were not labeled and she then came and got me, IIC to check out this issue. I observed the following in a grey tote: 1) There were 2 packages of fully labeled federal Summer Sausage products, 2) There was also six ten ounce packages of Summer Sausage with no labels, and 3) One approximately 2 ounce package of Summer Sausage. I then asked , Plant Manager, as to the status of these packages. He told me that this was federal product and the packages were leakers and had not been repackaged and immediately labeled as required. This is a violation of 9 CFR 317.1(a), a label within the meaning shall be displayed upon the immediate container of any product. This product was retained with USDA retain tag # B8267270 pending appropriate response by the establishment.

Regulation:

317.1(a) When, in an official establishment, any inspected and passed product is placed in any receptacle or covering constituting an immediate container, there shall be affixed to such container a label as described in 317.2 except that the following do not have to bear such a label.
