Citation: At 0845 on 03-14-2012 I conducted a labeling compliance check in the product storage freezer. I observed several dozen to several hundred boxes of product. The product was generally kept in cardboard boxes. The boxes had on the exterior the USDA inspection seal with the establishment number, the establishment name and a checkbox listing of possible products including "Assorted Beef Cuts, Assorted Pork Cuts, Ground Beef." There was also a blank line listed for other product. In many of these boxes there were no selections made on the checkbox list. There were also no other labels present. This prevented identification of the inside product as to species or type. This was also non-compliance with 9CFR 317.1 and 317.8. Mr. was shown these non-compliances visually, informed of them orally and writing with this non-compliance report. He orally proposed the corrective action of telling his workers to properly mark the checkboxes on the exterior of the boxes from now on. As always you have the right to appeal.
317.1 (c) No covering or other container which bears or is to bear a label shall be filled, in whole or in part, except with product which has been inspected and passed in compliance with the regulations in this subchapter, which is not adulterated and which is strictly in accordance with the statements on the label. No such container shall be filled, in whole or in part, and no label shall be affixed thereto, except under supervision of a Program employee.
317.8 (a) No product or any of its wrappers, packaging, or other containers shall bear any false or misleading marking, label, or other labeling and no statement, word, picture, design, or device which conveys any false impression or gives any false indication of origin or quality or is otherwise false or misleading shall appear in any marking or other labeling. No product shall be wholly or partly enclosed in any wrapper, packaging, or other container that is so made, formed, or filled as to be misleading.
