Violation:  416.2(b)(1), 416.2(b)(3)

Citation: Noncompliance of the Sanitation Performance Standards (SPS) regulations identified during routine inspection activities on this date October 12, 2011. [newline] 1) small upper cooler - Flaking paint observed; an area approx. 4ft. x 4ft. square in the center of the south wall involved, with a few smaller locations of loose paint near the floor. (no product in immediate area). [newline] 2) Door frame on the east wall of the kill floor - at base of door a 1/2" to 3/4" wide gap to the outside visible; this open juncture is approx. 12 to 14 inches in length. [newline] During the weekly exit meeting this week (1100 hrs) I brought to the attention of these noncompliant observations. I discussed my concerns for the potential of product adulteration with the flaking paint and the potential for rodent / pest infestation with the gap at the bottom of the door, especially this time of year with colder weather approaching. [newline] I notified of their regulatory responsibility in maintaining their facility in a manner to prevent insanitary conditions as per 9 CFR 416.1. No regulatory control action taken at this time; no product involvement. [newline] Corrective actions as per 9 CFR 416.15 are targeted for completion at the next scheduled operation on Tues. 10/18/11. Failure to address the noncompliant conditions may lead to further regulatory actions; tagging of area or areas. [newline] A review of the Noncompliance Record File in the gov't office revealed similar noncompliance - flaking paint in the upper cooler on 07/14/2010.

Regulation:

416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
