Citation: At 0600 hrs I observed approximately a half a holding tank full of chicken carcasses (approximately 50 chickens) without any wingtags or other form of identification in the large cooler. This is a non-compliance with 9CFR Reg 381.115. Inspected and passed poultry products are required to be labeled. Although this establishment has a religious exemption, they are still subject to all of the other applicable provisions of the Poultry Products Inspection Act and the regulations (9CFR 381.11(b)). For religious exempt poultry, items for retail sale must be individually identified with tags providing the following features: 1. A statement that the product was processed under a Buddhist or Confucian exemption or a statement of equal meaning, 2. The name of the religious official or organization under whose supervision the poultry was slaughtered, 3. The official establishment name and address 4. The establishment number If the items are destined solely for Hotel, Restaurant, or Institution, then they are not required to be individually identified, however the immediate container must then must be labeled with the features listed above, plus a statement that the product is for limited use only (ex. "for HRI only"), and an appropriate exemption statement: "Eviscerated Poultry Processed Under USDA Exemption Permit No. 04734 P." Currently this establishment does not have labeling containing a statement that the product is for limited use. The product was retained with US Retained Tag No. B37703223. Plant management was immediately notified of this non-compliance and inspection personnel witnessed that product was brought to the inedible compartment and was slashed and denatured.
381.115 Except as may be authorized in specific cases by the Administrator with respect to shipment of poultry products between official establishments, each shipping container and each immediate container of any inspected and passed poultry product shall at the time it leaves the official establishment bear a label which contains information, and has been approved, in accordance with this subpart.
