Citation: At approximately 1000 hours, I observed the following non-compliances: As I entered the establishment, I observed two "I Love NY" plastic bags containing product with Chinese characters handwritten on them. These two bags of product were loaded onto the metal trolley along with other bags of finished product poised at the exit of the establishment. The establishment's transport van was parked immediately outside with the back doors open. I immediately notified Plant owner, Mr. Shen Chen, that these "I love NY" bags are not properly labeled with the establishment's information, nor are they packaging materials for which the plant as a guaranty or statement of assurance that the bags comply with the FFDCA regulations. The use of these "I love NY" bags, which I had previously seen unused in the establishment, has previously been discussed with Mr. Shen Chen on a Weekly Meeting dated 1/8/11. This is a non-compliance with 9 CFR 381.144 and 381.115. The bags were U.S. Retained Tag No. B39593513.
381.115 Except as may be authorized in specific cases by the Administrator with respect to shipment of poultry products between official establishments, each shipping container and each immediate container of any inspected and passed poultry product shall at the time it leaves the official establishment bear a label which contains information, and has been approved, in accordance with this subpart.
381.144(a) Edible products may not be packaged in a container which is composed in whole or in part of any poisonous or deleterious substances which may render the contents adulterated or injurious to health. All packaging materials must be safe for the intended use within the meaning of section 409 of the Federal Food, Drug, and Cosmetic Act, as amended (FFDCA).
