Violation:  416.1, 416.2(a), 416.2(b)(3), 416.2(d)

Citation: At approximately 0715 hours during performance of a scheduled operational sanitation inspection, I observed the following non-compliances: 1. The back door to the establishment off the poultry killing area was found completely open to the outside without any screen or other type of door covering. Gnats were observed outside the open door. 2. The establishment's freezer was full of finished packaged product from floor to ceiling and I observed frozen condensate covering the packaged product. I further observed that the immediate containers of the product are paper bags, but the product is first packaged in clear plastic bags before going into the paper bags. The product in the paper bags have then been further packaged in another outer plastic bag. Although the outer plastic bags are covered in ice and ice is also present between the outer plastic bag and the paper bag, the packaged product is not adulterated due to the inner plastic bag layer. However the heavy amount of frozen condensate present covering the packaged product and the overstocking of the freezer with product, which prevents the ability to fully inspect the conditions of the product in the freezer, is creating an insanitary condition. Mr. was immediately notified of the above non-compliances.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
