Citation: At approximately 0830 hours, I observed the following noncompliance: In order to clean the freezer, establishment employees were removing fully packaged product from the freezer. Several of the paper bags were torn and one paper bag contained 5 chicken carcasses each wrapped in "I Love NY" bags and approximately 9 bags of plain white plastic bags with chicken carcasses in them. I retained the bags with U.S. Retain Tag #B37802943 and immediately notified Mr. plant president. He was unable to show me a letter of guarantee or statement of assurance for either bags that they comply with FFDCA regulations. Additionally both the "I Love NY" and plain white bags are not properly labeled with the establishment's information as an immediate container. Mr. was informed of these noncompliances with 381.144 and 381.115. Past Similar NRs - Previous Ineffective Plant Actions: We don't use I Love NY plastic bags. NR: 15-2011 dated 4/20/2011. Use of these bags were also discussed previously during weekly meetings dated 1/8/11, 4/22/11 and 4/29/11.
381.115 Except as may be authorized in specific cases by the Administrator with respect to shipment of poultry products between official establishments, each shipping container and each immediate container of any inspected and passed poultry product shall at the time it leaves the official establishment bear a label which contains information, and has been approved, in accordance with this subpart.
381.144(a) Edible products may not be packaged in a container which is composed in whole or in part of any poisonous or deleterious substances which may render the contents adulterated or injurious to health. All packaging materials must be safe for the intended use within the meaning of section 409 of the Federal Food, Drug, and Cosmetic Act, as amended (FFDCA).
