Citation: At approximately 1100 hrs while performing a schedule task code (04B04) Labeling - in order to verify that establishment was meeting with the regulatory requirements of 9CFR 317.2 (i). 317.8I observed in the cooler at back of plant, an edible pre chill barrel with (4) guinea hens bearings a wing tag , indicating the poultry is ( Halal , from poultry market ([redacted] .This wing tag was from prior establishment. Poultry was misbranded. Management recently informed inspection personnel, they were short on their wing tags, and would probably run out before new supply arrives. They were informed in order to lengthen the use of wing tags; Confucian poultry must always have a wing tag with no exception to destination of poultry. On the other hand in situations that cause difficult time , an with approval , establishment my ship out Buddhist Exempt Product without wing tags if it is being shipped to hospitals, resturants,and institutions , and bags labeled (HRI). When further detail of matter was requested, management in formed, employee mistakenly picked up the only case of tags found in supply room and their was no malice intent. Further inspection of product showed no other product was mislabeled. Mr. the establishments President were informed verbally, and in writing with this NR. They failed to meet with the regulatory requirements of regulations 9CFR 317.2(i) ,317.8 .Continued failure to meet regulatory requirements would lead to further enforcement action. No trend found with this noncompliance.
317.2(i) The terms spice, natural flavor, natural flavoring, flavor and flavoring may be used in the following manner:
317.8(a) No product or any of its wrappers, packaging, or other containers shall bear any false or misleading marking, label, or other labeling and no statement, word, picture, design, or device which conveys any false impression or gives any false indication of origin or quality or is otherwise false or misleading shall appear in any marking or other labeling. No product shall be wholly or partly enclosed in any wrapper, packaging, or other container that is so made, formed, or filled as to be misleading.
