Violation:  416.1, 416.2(b)(1)

Citation: On Thursday, January 12, 2012, at approximately 0625 hour, prior to start of the operation, I observed the following non-compliance. In the evisceration/processing room, water was dripping down from ceiling to the floor nearby the wax melt stove unit, creating an insanitary condition. The evidence was immediately shown to the Plant Manager, A regulatory control action was initiated to restrict the use of this area (U.S. Rejected Tag#B39907637) until corrective action could be performed. No product was affected. This is in violation of 9CFR416.1 and 416.2(b)(1). Continued failure to meet regulatory requirement would lead to further enforcement action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
