Citation: On Wednesday, February 1, 2012, at approximately 1420 hours, I observed the following non-compliance. In the shipping area nearby the management office, an employee was smoking a cigarette, creating an insanitary condition of this area where there were bags of packed products kept in this area, ready to be shipped. The evidence was shown to the Plant Manager, Employee smoking was immediately stopped and no product was affected. This is in non-compliance with Regulation 9CFR 416.4(d) which states "Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishment". Continued failure to meet regulatory requirement would lead to further enforcement action.
