Violation:  381.76(b)

Citation: On Thursday, February 16, 2012, at approximately 0620 hours, I observed the following non-compliance. In the cooler #2 where finished products were kept overnight, a tank with about 12 eviscerated carcasses of Guineas Hens were contaminated with ingesta on the surfaces of the carcasses. The ingesta was ranged from 1/2" to 2", spreading out at different spots on each carcass. The evidence was immediately shown to the plant manager, An U.S. Retained Tag (#B39907621) was applied to the affected tank to restrict the use of the products until corrective action could be performed. This is a non-compliance of Regulation 9 CFR 381.76 (b)(3)(ii)(c) for finished product standard of finished birds on extraneous materials (Table 1). Continued failure to meet the regulatory requirement would lead to further enforcement action.

381.76(b) Action number. A level reached by the CUSUM where the process is out of control and product action is required by the establishment or the inspector. See Table 2.
