Citation: On Friday, March 23, 2012, at approximately 0635 hours, I observed the following non-compliance in the delivery truck that was parked near the entrance of the building and ready to be used. Upon opening the door of the truck, a clear plastic cover affixed to the wall nearby the door was noted with numerous black specs on its surface. The evidence was immediately shown the the plant manager, nbsp; He explained that this plastic cover was a remaining piece from the original air curtain that should have been removed. A regulatory control action was initiated (U. S. Rejected Tag # B38264252) to restrict the use of the truck until corrective action could be performed. [newline]This is a non-compliance with Regulation 9 CFR 416.4 (d) and 381.190 (c), which states "------ the means of conveyance shall be reasonably free of foreign matter (such as dust, dirt, rust, or other articles or residues), and free of chemical residues, so that product placed there in will not become adulterated.--------".  Continued failure to meet the regulatory requirement would lead to further enforcement action.[newline] 

Regulation:

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
