Violation:  416.2(b)(1)

Citation: On Tuesday, May 8, 2012, at approximately 0620 hours, I observed the following non-compliance.  In the edible cooler#2 where finished products were kept overnight inside stainless steel tanks, a strip of silicon sealant about 20" long was peeling off from middle of the ceiling, hanging loose in the air, and beads of water condensed on the strip and ceiling were slowly dripping down to the floor.  A regulatory control action was initiated and an U.S. Rejected Tag (#B38033332) was applied to the affected area.  Evidence was immediately shown to the plant manager, nbsp; No product was affected (no product was stored directly under the dripping water).[newline]This non-compliance is in violation of 9 CFR 416.2 (b)(1).  Continued failure to meet the regulatory requirements would lead to further enforcement action.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
