Citation: On July 25, 2011 at approximately 0930 hours while performing an unscheduled 06D01 procedure, Inspector [redacted] observed the following Non-Compliance: The upper horizontal bar of the head chute, in which the restraints slide has paint flaking off of it. The blue paint is worn off of most of it, but what is left is loose and flaking. There was no evidence of the paint chips on the livestock, no product adulteration was observed. Plant owner Jim Wright was notified of this Non-Compliance. This are in violation of 9 CFR 416.4(b) which states: Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. The establishment was notified verbally and in writing of this NR of the Non-Compliance. The establishment was also advised of their right to appeal this decision delineated by 9 CFR 306.5.

Regulation:

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
