Citation: On October 6, 2011, at approximately 1130 hours, while performing an unscheduled 06D01 task, Inspector [redacted] observed the following Non-Compliances: the door sweep on the right door leading into the establishment has rusted and pulled away from the door. Also, on the inside door frame on the bottom of both sides, approximately five(5) inches high the metal has rusted and rotted away. These are in violation of 9 cfr 416. 2(b)(1) and (b)(2) which states: (1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions. (2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions. These are areas in which no product passes and not product adulteration was observed. Plant Owner Jim Wright was notified of these Non-Compliances. The establishment was notified verbally and in writing of this Non-Compliance. The establishment is also notified that any further Non-Compliance with regulatory requirements could result in additional regulatory and/or administrative actions. Management is also advised of their right to appeal this decision delineated by 9 CFR 306.5.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
