Citation: At approximately 0900 while performing an SPS verification task, the following noncompliance was observed. In the hide/inedible room of the plant, the right and left corners of the room directly off the main door are in need of a general cleaning. The walls have black sot built up on them, there is clothing hanging on the wall that also has black sot on it, there is a pile of used rubber gloves that has overflowed onto floor, and cobwebs hanging from the walls and ceilings. Mr. was immediately notified about these conditions. These conditions are a noncompliance of regulations 416.4(b), 416.1, and 416.2(b)(2). Mr. is also advised of his right to appeal this decision as delineated by 9 CFR 306.5.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
