Citation: At 0900 hrs. on the day of 06/25/2010 I was performing the unscheduled task of 06D01 and the following noncompliance was observed. In the final wash area the chill cooler door caulking has a black moldy substance on it and some of it is pulled off. The rack that holds the tubs for the variety meats has a residue buildup on it. I proceeded to show [redacted] the said noncompliance. I then checked the plants records for documentation and found none. This is in violation of regulation 416.1 which states that: Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. I then checked for similar NR's and found 3 and they are 1) 06/28 # 2010 0009, 2) 04/21 # 2010 0007, 3) 04/09/10 #2010 0006 of the same root cause. With this written document Mr. [redacted] will have been notified in writing and orally of the said noncompliance. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative actions. Mr. [redacted] is also advised of his rights to appeal this said decision as delineated by 306.5 and/or 381.35 of 9 CFR.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
