Violation: 317.2(c), 416.1, 416.2(b)(1), 416.2(d)

Citation: On August 8, 2011 while performing and unscheduled PBIS task 06D01 of the facility, the following noncompliances was observed. In the carcass final wash area the floor wall junction were the carcasses come through the doorway at the bottom left hand side there is a gap between the glass board wall and the floor of about an inch wide and about 12 inches long. Also, there is an unused chimney vent that is not properly sealed in the final wash area. In the carcass chill cooler on the left side of the storage cooler there is condensation dripping off of the light fixture, and there is also a metal support post that is showing signs of rust on it. There was no regulatory control action taken because there was no product involved. I then verbally notified Mr. [redacted] of the above deficiencies. This is a violation of part 416.1 General rules. Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 416.2(b) Construction. (1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions. 416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided. I then reviewed the NR file and found 2 NR's and they were 0005-2011-17496 from 06/24/11 and 0004-2011-17496 from 06/01/11.

Regulation:

317.2(c) Labels of all products shall show the following information on the principal display panel (except as otherwise permitted in this part), in accordance with the requirements of this part or, if applicable, part 319 of this subchapter:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
