Citation: At approximately 0720 while performing a scheduled 01BO1 PBIS code the following unscheduled 06D01 noncompliance was observed. After picking a random area for inspection, the slaughter floor supervisor told me that the area was ready. While performing the pre-op inspection of the knocking pen, I found hair and dried mud on the back steel wall of this area. I immediately told the slaughter floor supervisor [redacted]) about these conditions and he proceeded to clean and sanitize the area while I continued my Pre-OP inspection. I re-inspected the area in question and passed it for today's slaughter process. I then informed Mr. [redacted] of these conditions orally and in writing. I checked for similar NR's and found none dealing with this area. This is a noncompliance with regulation 416.1; each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that the product is not adulterated, and 416.4(b); non food contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative actions. Mr. [redacted] was also advised of his right to appeal this decision as delineated by 9 CFR 306.5.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
