Citation: At approximately 01015 hrs. while standing at the entrance between the Injection/Ham stuffing department and wash area for equipment, I observed an employee washing metal shelves used for smoking product ( which are direct product contact surfaces). The employee washing the shelves had the racks setting directly on the floor (which is a non product contact surface). I also observed the employee rest some of the metal shelves on his boot to wash some of the other shelves and then set them back down on the floor before he put it on a stack of approximately 10 other shelves that were to be used for production at a later time. I immediately applied USDA Retain/Reject Tag to the rack of shelves and informed Mr. [redacted] (lead person)and Mr. [redacted] (supervisor). of the non compliance. While Mr. [redacted] was instructing the employee to reclean the shelves the employee pick up the USDA Retain/Reject tag and toss in a tank of dirty equipment. I informed Mr. [redacted] that the employee should know not to remove any tags applied by the USDA. Mr. [redacted] remove some of the items in the tank and retrieved the tag. A few weeks ago Mr. [redacted] explained the proper procedure on cleaning similar equipment in my presence, to the same employee that was cleaning the equipment off the floor and not using the rack provided by the plant for cleaning the equipment. Regulatory control action was relinquished when sanitary were restored. The plant is not meeting 9 CFR 416.4(d) & 416.6. 416.6 Tagging insanitary equipment, utensils, rooms or compartments. States, " When FSIS program employee finds that any equipment, utensil, room, or compartment at an official establishment is unsanitary or that its use could cause adulteration of product, he will attach to it a " U.S. Rejected" tag. Equipment, utensils rooms, or compartments so tagged cannot be used until made acceptable."ONLY" an FSIS program employee may remove a "U.S.Rejected"tag. 416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
