Citation: While performing an FSA, EIAO [redacted] observed the following:
A small amount of tumbled ham product was observed on the floor just inside the doorway of the Raw Product Cooler. [redacted] ,HACCP Coordinator, (who accompanied me on the tour) also observed the tumbled ham product and took immediate corrective action by notifying sanitation, who removed the product from the floor and placed it into an “Inedible“ barrel. Sanitation then cleaned the floor, restoring sanitary conditions. Ms. [redacted] HACCP Coordinator, was shown the non-compliance. This fails to meet the regulatory requirements of 9CFR 416.4(d) and 416.1.
The establishment appealed the NR on 4/23/2012. Discussed with EIAO and appeal granted on 5/15/2012 see attached MOI.

Regulation:

416.16(a) Each official establishment shall maintain daily records sufficient to document the implementation and monitoring of the Sanitation SOPís and any corrective actions taken. The establishment employee(s) specified in the Sanitation SOPís as being responsible for the implementation and monitoring of the procedure(s) specified in the Sanitation SOPís shall authenticate these records with his or her initials and the date.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
