Violation: 416.1, 416.2(b)(1), 416.2(e)(3), 416.3(b)

Citation: At approximately 0715 hours on 10-04-2010 while performing 01B01, I found the following 06D01 noncompliance. 1) The water pipe in the maintainance room on the left bottom wall by the entrance is leaking. 2) The floors by the outside walls are not visible all the way to the walls to be able to inspect the area properly for cracks leaks or vermon. This is in violation of 9CFR 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. CFR 416.2 (b) Construction. (1) Establishment buildings, including their structures, rooms, and compartments must be ofsound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions. 9CFR 416.2 (e) (3) Prevent adulteration of product, water supplies, equipment, and utensils and prevent the creation of insanitary conditions throughout the establishment; And 9CFR 416.3(b) Equipment and utensils must not be constructed, located, or operated in a manner that prevents FSIS inspection program employees from inspecting the equipment or utensils to determine whether they are in sanitary condition. [redacted] 2nd was informed of this noncompliance verbally and in writing by this noncompliance report. The noncompliance was in an non production area and therefore no product was affected. I checked the plants PIP and and pre operational log and no deficiencies were found. No similar NRs were fuond in the last sixty days.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(e)(3) Plumbing. Plumbing systems must be installed and maintained to: Prevent adulteration of product, water supplies, equipment, and utensils and prevent the creation of insanitary conditions throughout the establishment;

416.3(b) Equipment and utensils must not be constructed, located, or operated in a manner that prevents FSIS inspection program employees from inspecting the equipment or utensils to determine whether they are in sanitary condition.
