Violation: 416.1, 416.4(a), 416.5(a), 416.13(b), 430.4(b)(3)

Citation: On 11/23/2010 at approximately 1130 hours, following a FSA (Food Safety Assessment), the following Listeria SSOP deficiency was noted. The testing of food contact surfaces was observed and the sample was far less than one square foot. The plant or [redacted] (designated lab sampler) has failed to perform the sampling as described in the Listeria SSOP program. This does not meet the establishments Listeria program of, " [redacted] " as prescribed in 9 CFR 430.4(b)(3)(D), "Identify the size and location of the sites that will be sampled." This is also a violation of 416.13(b) "Each official establishment shall conduct all other procedures in the Sanitation SOP's at the frequencies specified." [redacted] 2nd was informed verbally and in writing with this noncompliance report. The lab technician was instructed to take the sample in the prescribed procedure therefore no product was affected by this noncompliance. No similar NRs were found in the last sixty days.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.5(a) Cleanliness. All persons working in contact with product, food-contact surfaces, and product-packaging materials must adhere to hygienic practices while on duty to prevent adulteration of product and the creation of insanitary conditions.

416.13(b) Each official establishment shall conduct all other procedures in the Sanitation SOPís at the frequencies specified.

430.4(b)(3) In order to maintain the sanitary conditions necessary to meet this requirement, an establishment producing post-lethality exposed RTE product must comply with the requirements included in one of the three following alternatives: Alternative 3. Use of sanitation measures only.
