Citation: Today, 1/11/2012, at approximately 0730 hours while performing a Sanitation Performance Standard task, I observed the following non-compliances. On the kill floor, just off to the right and above the head inspection station, the overhead lighting fixture has two blown bulbs and the actual lighting fixture is beginning to rust and show signs of what appears to be flaking paint. Also, overhead, off to the right of the light fixture is a heating unit that is dirty and is beginning to rust as well. In the inedible room, there is another light fixture that is rusty and dirty, and only functions properly part of the time. These deficiencies are in violation of 9CFR 416.1 which states " Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated" and 9CFR 416.4(b) which states "Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product". A review of available plant records indicated no notation of these deficiencies. A review the noncompliance file indicated no similar noncompliance in the past 60 days. I have verbally informed Mr. [redacted] II of these issues as well as with this written document.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(c) Light. Lighting of good quality and sufficient intensity to ensure that sanitary conditions are maintained and that product is not adulterated must be provided in areas where food is processed, handled, stored, or examined; where equipment and utensils are cleaned; and in hand-washing areas, dressing and locker rooms, and toilets.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
