Citation: While entering the pens to perform antemortem inspection duties and to verify the humane activity tracking category of ensuring water availability in the pens of establishment M9400 at approximately 0850 hours, I discovered several dairy cows were left without access to water in the serpentine chute and crowd gate (the circle) area of the establishment for approximately seventy minutes while the plant was not operating due to a mechanical failure on the dressing floor. Approximately eight cows were in the serpentine chute and approximately twenty cows were in the circle during this time. None of the cows were dehydrated or in any distress or discomfort. Since all the pens were full, all but two cows were immediately moved to alley ways that had access to water tubs. The other two cows were placed into the knock box and individually humanely euthanized because they resisted being backed out of the serpentine chute. Pens Supervisor, Mr. was notified of this noncompliance. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

313.2(e) Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. There shall be sufficient room in the holding pen for animals held overnight to lie down.
