Citation: At 06:10 while performing pre-operational sanitation inspection on the slaughter floor the following Sanitation Performance Standard noncompliance was observed. There are two blue barrels that are used to collect inedible materials from the slaughter operation that do not bear any conspicuous and distinctive marking to identify permitted uses as required by 9CFR416.3. There also are gaps at the bottom of the doors leading to the outside on the door in the room between the slaughter floor and the pens, the door from the processing room to the loading dock and the door in the equipment storage room. This is a violation of 9 CFR 416.2 (b)(3) which states, "Walls, floors, ceilings, doors, windows and other openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats and mice". [redacted] was notified of these noncompliances. I checked for similar NR's and found none. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative actions. Mr. [redacted] is also advised of his right to appeal this NR as delineated in 9 CFR 306.5.

Regulation:

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.3(c) Receptacles used for storing inedible material must be of such material and construction that their use will not result in the adulteration of any edible product or in the creation of insanitary conditions. Such receptacles must not be used for storing any edible product and must bear conspicuous and distinctive marking to identify permitted uses.
