Citation: At 08:00 while performing an unscheduled 06D01 Sanitation Performance Standard inspection of the walk in freezer located on the loading dock the following noncompliance was observed. There are boxes of product stored directly on the floor with boxes stacked on top of them on the left side and rear of the freezer. Behind these boxes and on the right side are built in shelves made of 2"X4" lumber. The bottom shelf is in direct contact with the floor and is loaded with more boxed product. This is creating an overcrowded condition which makes it difficult for the inspection personnel to verify compliance with the 9 CFR 416.2(b) (1), because the overcrowded condition of the freezer obstructs the access to some parts of the freezer for observation. This is a violation of 9CFR 416.2(b)(1) which states, "Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions". Mr. [redacted] was notified of this noncompliance. . I checked for similar NR's and found none. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative actions. Mr. [redacted] is advised of his right to appeal this NR as delineated in 9 CFR 306.5.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
