Citation: 3 May 2011 at approximately 1000 while performing a 03G02 procedure I observed the following non compliance with the regulatory requirements of 9 C.F.R. 417.5(b), record authenticity and 9 C.F.R. 417.5(c), pre-shipment review. At approximately 0700 I reviewed the Smokehouse report and noticed that an entry for a 160 pound batch of T.P.C. Keilbossi (Est. brand name Kielbasa) was started on 5-2-11. The record indicated that the monitoring was performed by a data logger. The verification and pre-shipment review columns were blank at this time. I then checked the packing room and noticed the Keilbossi was being packaged. At 1000 I checked and the product packaging was complete and the product was moved to the finished product cooler. I reviewed the Smokehuose report and observed that the data logger had been verified and the actual time/temperatures were listed with the date and time of the verification activity along with the verifier's initials. The critical limits for the cooking and chilling cycles were met. The pre-shipment review column was also completed however the column only contained the signature of the reviewer. This form is set up with so that all monitoring and verification activities for a specific lot are on one line with the date being the first entry. The date on this line is 5-2-11 suggesting that the pre-shipment review was conducted on 5-2-11; however the pre-shipment review was actually conducted on 5-3-11. This document serves as written notice that your failure to comply with the regulatory requirements of 9 C.F.R. 417.5 (b) and 9 C.F.R. 417.5(c), both require the entry to include the date the specific event occurs, could result in additional regulatory or administrative actions.

Regulation:

417.5(b) Each entry on a record maintained under the HACCP plan shall be made at the time the specific event occurs and include the date and time recorded, and shall be signed or initialed by the establishment employee making the entry.

417.5(c) Prior to shipping product, the establishment shall review the records associated with the production of that product, documented in accordance with this section, to ensure completeness, including the determination that all critical limits were met and, if appropriate, corrective actions were taken, including the proper disposition of product. Where practicable, this review shall be conducted, dated, and signed by an individual who did not produce the record(s), preferably by someone trained in accordance with 417.7 of this part, or the responsible establishment official.
