Citation: At approximately 945 hours, while performing the SPS verification procedure, in order verify that the establishment was meeting the regulatory requirements of 416. The following non-compliances were observed: (1) Condensation was observed on the two pipes of the cooling unit in the smoke cooler, no product was involved at the time of my observation. (2) Door entry from outside to the maintenance room was observed not to fully seal on the bottom, showing light from outside (3) Multiple spots on the knocking pen were showing rust (chains, latch, handle and bolts) on the kill floor .Establishment management Mr. [redacted] has received oral and written communication concerning these noncompliance’s. This document serves as a written notification that your failure to comply with regulatory requirement could result in addition enforcement action as described in 9 CFR part 500. [newline][newline]This is a failure to comply with the following regulations: [newline][newline]9 CFR 416.1 General rules which clearly states: Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. [64 FR 56417, Oct. 20, 1999] [newline][newline]9 CFR 416.2(b)(1) which clearly states: Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.[newline] [newline]9 CFR 416.2(b)(3) which clearly states: Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.[newline] [newline]9 CFR 416.2(d) Ventilation. Which clearly states: Ventilation adequate to control odors vapors and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
