Citation: At 0715 hours while performing the 01B02 procedure in the slaughter floor area of the establishment the following noncompliances were observed. A meat particle from a previous production day was observed on one of the giblet stainless trays used during the slaughter operations. Mr. [redacted] was notified. A corrective action was immediately taken. No regulatory control action was taken because this item was cleaned and sanitized immediately. Also the door leading from the smokehouse area to the outside was left open. Mr. [redacted] was immediately notified of this observation as well. This door was then closed. No product was retained due to these noncompliances. No similar noncompliances have been recently documented. 9 CFR 416.13(a) states "Each official establishment shall conduct the pre-operational procedures in the Sanitation SOP's before the start of operations." 9 CFR 416.4(a) states "All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product." 9 CFR 416.2(b)(3) "Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice." You are hereby advised of your right to appeal this decision as delineated by 306.5 and/or 381.35 of 9 CFR. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

317.8(a) No product or any of its wrappers, packaging, or other containers shall bear any false or misleading marking, label, or other labeling and no statement, word, picture, design, or device which conveys any false impression or gives any false indication of origin or quality or is otherwise false or misleading shall appear in any marking or other labeling. No product shall be wholly or partly enclosed in any wrapper, packaging, or other container that is so made, formed, or filled as to be misleading.

416.13(a) Each official establishment shall conduct the pre-operational procedures in the Sanitation SOP’s before the start of operations.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
