Citation: At 0720 hours while performing the 06D01 procedure in the bottom cooler area of the establishment the following noncompliance was observed. Condensation was observed in the overhead area of the entrance to the cooler. Also condensation was observed on the bottom of the unit in this cooler and also observed dripping from the overhead area in front of the unit toward the middle of the ceiling. No product was located under the condensation at the time and no product was retained. Mr. [redacted] and Mr. [redacted] were notified. Mr. [redacted] wiped the area down upon notification. The door and frame from the outside leading into the inedible room was found to be damaged on the bottom. From the entrance to the inedible room going to toward the front of the building, the door located along this wall which leads to a storage area was also found to be damaged along the bottom allowing a space between the building and the door. Mr. [redacted] was notified of this. Mr. [redacted] and Mr. [redacted] said they would add these items to the Plant Improvement Plan. 9 CFR 416.2(b)(1) states "Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions." 9 CFR 414.2(d) states "Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided." No product was retained due to this noncompliance. No similar noncompliance was found to be documented. You are hereby advised of your right to appeal this decision as delineated by 306.5 and/or 381.35 of 9 CFR. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
