Citation: At 0805 hours while performing the 06D01 procedure in the lower carcass cooler area of the establishment the following noncompliance was observed. A roaster swine slaughtered last week on 3/23/11 under custom exemption regulations was not labeled as "Not for Sale". Mr. [redacted] was immediately notified of this noncompliance. Mr. [redacted] then labeled the carcass appropriately. 9 CFR 303.1(a)(2)(iii) states "The custom prepared products are plainly marked "Not for Sale" as provided in 316.16 of this subchapter, immediately after prepared and kept so identified until delivered to the owner." No product was retained due to this noncompliance. No similar noncompliances were recently documented.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.5(b) Clothing. Aprons, frocks, and other outer clothing worn by persons who handle product must be of material that is disposable or readily cleaned. Clean garments must be worn at the start of each working day and garments must be changed during the day as often as necessary to prevent adulteration of product and the creation of insanitary conditions.

303.1(a)(2)(iii) The custom prepared products are plainly marked ‘‘Not for Sale’’ as provided in § 316.16 of this subchapter, immediately after being prepared and are kept so identified until delivered to the owner;
