Violation: 416.1, 416.2(a), 416.2(d), 303.1(a)(2)(iii)

Citation: While performing an 01B02 the following 06B01noncompliance was found. In the lower cooler there were three carcasses hanging with no identification. Further investigation revealed the carcasses were and to be used for dog food and place in the wrong cooler. Since the violation included both amenable and nonamenable species, supervisory advise was sought. It was decide that this violation should be written as a labeling violation under custom not identified as "not for Sale". This is a violation of 303.1(a)(2)(iii) If the custom operator prepares or handles any products for sale, they are kept separate and apart from the custom prepared products at all times. The custom prepared products are plainly marked "Not for Sale" immediately after being prepared and are kept so identified until delivered, provided in 316.16 of this subchapter. Mr. was notified orally and in writing with this NR of this noncompliance.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

303.1(a)(2)(iii) The custom prepared products are plainly marked ‘‘Not for Sale’’ as provided in § 316.16 of this subchapter, immediately after being prepared and are kept so identified until delivered to the owner;
