Citation: On July 14, 2010 at 0630 hours, while performing SPS task 06D01, I found that the heater mounted overhead in the slaughter area has an accumulation of rust on the outer cabinet. I found no documentation of this noncompliance on the PIP form however it was noted for the same problem and completed on April 30, 2010. I did not take a regulatory control action due to the nature of this noncompliance. I informed [redacted] of this noncompliance. You have failed to meet 9CFR416.2 (b)(1) which states," (b) Construction. (1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions." This document serves as a written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action. You are hereby advised of your right to appeal this decision as delineated by 306.5 and/or 381.35 of 9cfr.
