Citation: At approximately 07:20 am on August 2, 2010 while performing PBIS task 01B02 procedure the following noncompliances were observed. In the holding cooler above the rails on the beams there is beaded condensation and dripping condensation in several different areas of the cooler. In the same area there is also beaded condensation underneath the drip pan. In the chill cooler there is beaded condensation along the wall on the right side of the cooler inside the cooler door. In both coolers there is a brown stain on the wall approximately 1'x1' area where the sponge mop is stored by leaning it against the wall. Mr. [redacted] was verbally notified. No product was stored under the dripping condensation. I reviewed the plant's SSOP corrective action log and found no documentation on the above deficiencies. This is a violation of part 416.1 General rules. Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated 416.2(d)(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided 416.2(b)2(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions. I reviewed the NR file and found no recent noncompliance report of this nature. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative action. Mr. [redacted] is also advised of his right to appeal this decision as delineated by 306.5 of 9 CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
