Citation: On September 13, 2010, at 0730 hours, while performing antemortem inspection, I found the following noncompliance in the hallway of the animal pens. The walls, ceiling, light shade and electrical box have an accumulation of dust and sawdust-like material. Also both cabinets are in need of a general cleaning. I found no documentation of this noncompliance in the PIP records. I informed [redacted] and [redacted] of this noncompliance. You have failed to meet 9CFR416.1 which states, "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated." and 416.2 (b)(1) which states," Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions." This document serves as a written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
