Citation: At approximately 0825 hrs on January 19th 2011 at establishment 9581 known as Livingston's Packing Company the following non-compliance was detected within the kill floor area: The west by north-west side of the ceiling being a semi-bright non-porous metal was found to be littered with spots of residues from livestock that had been shackled in the vicinity on previous shifts, the trolley beam running the length of the ceiling to enable the hoists travel was found to have rust and flaking paint on the anterior surface, and a small section of metal trim on the lower right corner of the cooler door threshold is slightly disfigured and turned up away from the wall. None of the above mentioned non-compliances observed are food contact surfaces and no product was involved or adulterated as a result. The mentioned findings are non-compliances of 9CFR 416.2(b)(1) that states in part "Establishment buildings including their structures must be of sound construction and kept in good repair" and also of 9CFR 416.4(b) that states in part "on-food contact surfaces of facilities, equipment, and utensils used in operation of the establishment must be cleaned as necessary to prevent the creation of an insanitary condition." Mr. [redacted] was notified of the non-compliance. This document serves as written documentation that your failure to comply with regulatory requirements could result in additional regulatory or administrative action.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
