Citation: On Friday, March 23, 2012, at approximately 0730 hours, I was performing the Humane Handling for the slaughter of Livestock, verifying the category VIII, Stunning Effectiveness. They had a Holstein bull in the knocking pen and were going to stun it using a .22 rifle. I observed the following regarding the stunning: employee Frank was using a .22 rifle and when he shot the animal he didn’t render it unconscious. After the first shot there was no reaction from the bull, but he remained standing. Immediately Mr. [redacted] reloaded the gun and shot the bull rendering it unconscious. This is a violation of USDA regulations 9 CFR 313.16(a) (1) and (3). This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action(s). You have the right to appeal this decision based on 9 CFR 306.5 and 9 CFR 381.35.

Regulation:

313.16(a)(1) Utilization of firearms, required effect; handling. The firearms shall be employed in the delivery of a bullet or projectile into the animal in accordance with this section so as to produce immediate unconsciousness in the animal by a single shot before it is shackled, hoisted, thrown, cast, or cut. The animal shall be shot in such a manner that they will be rendered unconscious with a minimum of excitement and discomfort.
