Citation: At approximately 0815 hrs on January 28, 2011, while performing a scheduled 06D01, the following noncompliance was observed. In the carcass cooler on the left side of the door, there are shelves for storing product, and there is unidentified product on these shelves. Beside the shelves, there are two barrels of unidentified boneless meat. Plant management identified the product on the shelves as retail product, and the meat in the barrels as wholesale boneless beef trim. Mr. [redacted] was verbally notified of the above noncompliances. This is a violation of part 317.1(a) "When, in an official establishment, any inspected and passed product is placed in any receptacle or covering constituting an immediate container, there shall be affixed to such container a label as described in 317.2." I then reviewed the NR file and found no recent noncompliance of this nature.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

317.1(a) When, in an official establishment, any inspected and passed product is placed in any receptacle or covering constituting an immediate container, there shall be affixed to such container a label as described in ß 317.2 except that the following do not have to bear such a label.
