Citation: On February 8, 2011 while observing the stunning procedure for cattle, I observed the following non-compliant conditions. The plant uses a .22 caliber rifle as their method of stunning for cattle. I observed Mr. [redacted] shoot a steer with the .22 caliber rifle, the animal buckled but was not rendered unconscious. He then followed with a second shot that was ineffective and then followed with a third shot that rendered the animal unconscious. The animal was not vocal and did not exhibit any pain during this time frame which lasted less than 10 seconds. The animal should have been rendered unconscious with a single shot from the rifle. I immediately notified Mr. [redacted] of the non-compliant condition, the violation of the Humane Methods of Slaughter Act, and the failure to meet the Meat and Poultry Regulation 9CFR 313.16. CONTINUED FAILURE TO COMPLY WITH THE REGULATORY REQUIREMENTS COULD LEAD TO ENFORCEMENT ACTIONS DESCRIBED IN 9CFR 500.4


313.16 The slaughtering of cattle, calves, sheep, swine, goats, horses, mules, and other equines by shooting with firearms and the handling in connection therewith, in compliance with the provisions contained in this section, are hereby designated and approved as humane methods of slaughtering and handling of such animals under the Act.
