Citation: On Thursday 12/08/2011 at establishment 09714 at approximately 1330 the following non-compliance was observed on the processing side of the establishment.. No product was involved. 1. While walking through the processing area of the establishment, Dr. [redacted] noticed a cart was rusted and had broken wooden boards on the platform. There were two boxes of custom sausage on the cart that were in the process of being reboxed. U.S. Rejected/U.S.Retained tag # 940234 was immediately applied to the cart. Although no inspected product was in the room, the cart was in a area where inspected product passes through. 2. The door that is located beside the RTE cooler that leads to the outside premises has a gap on the right side and on the bottom of the door approximately 1/4 " and smaller. This could lead to the entrance of flies or mice into the establishment. 9CFR Regulation states: 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice. This document serves as written notification that you’re failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.” You are hereby advised of you’re rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
