Citation: On Wednesday 02/15/2012 at approximately 0930 while performing a schedules 06D01 SPS procedure, the following non-compliance was observed on the slaughter floor. No product was involved. In the hide room off of the slaughter floor, there is a garage door that is only opened when the beef hides are removed, (approximately once every two months.) The wooden door frame of the garage door is starting to pull away from the wall on the bottom right side, which is creating a gap to the outside between the door and the frame. The gap that leads to the outside is approximately 3 inches wide at the bottom and proceeds up along the door approximately 3 feet. The gap could allow vermin's to enter the establishment. Mr. [redacted] was immediately notified the non-compliance. This is a non-compliance of 9 CFR 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice. 416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions. This document serves as written notification that you’re failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.” You are hereby advised of you’re rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
