Citation: On Wednesday 04/14/2001 at approximately 0800 at establishment 09715 while performing a scheduled 06D01 procedure task, I observed the following non-food contact surface non-compliance. No product was involved. I noticed that the carcass rail in the carcass holding cooler and on the slaughter floor, is starting to show signs of rust. The rails are in need of cleaning and oiled. I also noticed in the same mentioned cooler that the 6 steel beams that run from the ceiling to the floor are starting to rust and paint is peeling approximately the bottom 3 feet of the beam. Mr. [redacted] was immediately notified of this verbally and in writing. Regulation 9CFR states: 416.2(b)(1) Establishment buildings, including there structures, rooms, and compartments must be of sound construction, be kept in good repair, and be sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions. 416.4(b) Non-food contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. This document serves as written notification that you're failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action." You are hereby advised of you're rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
