Citation: On Tuesday at approximately 0730 at establishment 09715 while performing an unscheduled 06D01 procedure task, I observed the following non-food contact non-compliances on the slaughter floor. No product was involved. 1. The table that is located in the center of the slaughter floor has a brownish colored protein build-up on the legs of the table and on the underside. The table also has small areas of rust starting to accumulate on the front of the table. 2. The stainless steel shelves that are located on the north wall of the slaughter floor that are approximately 5 feet in length by 3 feet in width are coated with a light coating of dust and dirt. There are also tools, old knives and paper towels that are not used cluttering the shelves. [redacted] was immediately notified verbally and in writing. 9CFR Regulation states: 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 416.4(b) Non-food contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. This document serves as written notification that you're failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action." You are hereby advised of you're rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
