Citation: On Thursday 08/11/2011 at establishment 09715 at approximately 0710 while performing a scheduled 01B02 (pre operational sanitation verification task) I observed the following non-food contact non-compliance's. No product was involved. 1. The sealed garage door in the processing room that is not in use and was constructed not to open, has a gap approximately 1/2 inch and smaller the length of the door on the bottom where the door meets the floor. The gap could lead to insects entering the establishment. 2. At the bottom of the steps that lead to the USDA office/ basement there is dirt and grime accumulating and is need of cleaning. In addition I noticed in the USDA office and the changing room beside the office has dirt and dead flies on the floor and cobwebs starting to accumulate in the corners of the walls. [redacted] was immediately notified of these non-compliances verbally and in writing. Regulation 9CFR states: 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions. 416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice. This document serves as written notification that you're failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action." You are hereby advised of you're rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
