Citation: On Wednesday 09/21/2011 at approximately 0630 at establishment 09715 while reviewing the generic E.coli sampling for the 13 weeks of verification for predominate species (lamb) I observed the following non-compliance. The final acceptable sample was dated 08/29/2011 and the previous acceptable sample was dated 08/01/2011 as I reviewed the slaughter records, lambs were slaughtered on 08/09/2011 and 08/11/2011, with no generic E.coli sample results for that week. All other samples were taken every week. Mr. [redacted] was immediately notified of this non-complianve verbally and in writing. 9CFR regulation states: 310.25(a), Criteria for verifying process control; E.colitesting.(1) Each official establishment that slaughters livestock must test for Escherichia coli Biotype 1 (E.coli) establishments that slaughter more than one type of livestock or both livestock and poultry, shall test the type of livestock or poultry slaughtered in the greatest number. The establishment shall: (v) Sampling in very low volume establishments. (A) Very low volume establishments annually slaughter no more than 6,000 cattle, 6,000 sheep, 6,000 goats, 6,000 horses, mules or equines, 20,000 swine or a combination of livestock not exceeding 6,000 cattle and 20,000 total of all livestock. Very low establishments that collect samples by sponging shall collect at least one sample per week, starting the first full week of operation after June 1 of each year, and continue sampling at a minimum of once each week the establishment operates until June 1 of the following year or until 13 samples have been collected, whichever comes first. Very low establishments collecting samples by excising tissue from carcasses shall collect one sample per week, starting the first full week of operation after June 1 of each year, and continue sampling at a minimum of once each week the establishment operates until one series of 13 tests meets the criteria set forth in paragraph (a)(5)(i) of this section. This document serves as written notification that you're failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action." You are hereby advised of you're rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
